Barrett Kornitsky, LLP 1 Essex Green Drive #4 Peabody, MA 01960 Dear Attorney Barrett: I have received the petition of Mary-Ellen Manning, Esq. appealing the response of the City of Peabody (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 18, 2022, Attorney Manning requested “[a]ll Zoning Board of Appeals (ZBA) meeting minutes and agendas dated from January 1, 2021 through December 31, 2021.” On November 1, 2022 and November 3, 2022, the City provided Ms. Manning with all ZBA minutes and agendas from January 1, 2021 through December 31, 2021. On November 21, 2022, Attorney Manning petitioned the Supervisor of Records (Supervisor), asserting, “[t]he City did produce the requested ZBA minutes but failed to produce the ZBA agendas.” As a result, this administrative appeal was opened. Withdrawal of Appeal In an email to this office on November 21, 2022, Attorney Manning indicated, “[p]lease be advised that Attorney Barrett of the [City] informed me that the documents that are the subject of my appeal have in fact been produced. The documents were labeled as minutes and the agendas were embedded in each of the document sets labeled as minutes. The appeal was filed in error. Please consider this notice that I formally withdraw the appeal of [the] Peabody Request #22-242.” This Office notes that the Peabody Request #22-242 pertains to the Supervisor’s administrative appeal, SPR22/2683. Conclusion Accordingly, based on Attorney Manning’s November 21st email to this office, I will consider this administrative appeal closed.
