Floyd appealing the nonresponse of the Fall River Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 15, 2022, Mr. Floyd requested the following records: [1] Any and all police reports regarding or pertaining to [a named individual]. [2] Any and all search warrant affidavits, criminal complaint applications, arrest reports or narratives, supplemental reports, or any or all reports of any kind generated by [several named employees]. [3] Any and all reports in which [several named employees] had any contact or investigated any crime that involved the Bristol County Children’s Advocacy Center. [4] Any and all criminal complaints sworn into the Fall River Court in which [a named individual] was the liaison between the courts and [the Department] from August 3, 2021 [to September 22, 2022]. [5] Any and all Office of Professional Standards Reports and investigative materials made, generated, or filed in the investigation of [several named employees]. [6] Any and all Use of Force reports made or generated by [several named employees]. Claiming to not yet have received responsive records, Mr. Floyd petitioned this office and this appeal, SPR22/2698, was opened as a result. Subsequently, I learned that the Department provided Mr. Floyd with a response dated October 3, 2022.
