Senior Counsel, Public Records and Records Management MassDOT/MBTA Office of General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Shorey: I have received the petition of Debra Waller appealing the response of the Massachusetts Department of Transportation (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 2, 2022, Ms. Waller requested: 1) The names and employers of the Newton CR Team on 7/7/22. 2) The identity of the author of the attached 7/7/22 email. 2) All emails sent to and from newtoncr@MBTA.com between 7/1/19 and 8/1/22. The Department provided a response on September 2, 2022. Unsatisfied with the response, Ms. Waller petitioned this office and this appeal, SPR22/2703, was opened as a result. Based upon a conversation between a Public Records Division staff member and a Department representative, it is my understanding that the Department intends on providing a further response to Ms. Waller. Accordingly, the Department is ordered to provide Ms. Waller with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Waller may appeal the substantive nature of the Department’s response within ninety (90) days.
