Deree Town Clerk Town of Weymouth 75 Middle Street Weymouth, MA 02189 Dear Ms. Deree: I have received the petitions of Gerard Mackin appealing the nonresponse of the Town of Weymouth (Town) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In separate requests, Mr. Mackin requested the following records on November 5, 2022: [1] All documents provided to Town employees regarding … safe disposal of mercury …[;] [2] All documents relating to plans by the Town to pay for unfunded mandates… [from] the period from January 1, 2018 to the date of your response[;] [3] All documents regarding the sufficiency of the number of school counselors in the public schools… [from] the period from January 1, 2018 to the date of your response[.] Claiming to not yet have received responsive records, Mr. Mackin petitioned this office and the following appeals, SPR22/2708, SPR22/2709, and SPR22/2710, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Mr. Mackin with a response to his requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office at pre@sec.state.ma.us. Mr. Mackin may appeal the substantive nature of the Town’s response within ninety (90) days.
