The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 2, 2022 SPR22/2727 Chief Jason LaForest Records Access Officer Egremont Police Department 171 Egremont Plain Road Great Barrington, MA 01230 Dear Ms. Mondello: I have received the petition of Andrew Quemere appealing the nonresponse of the Egremont Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 7, 2022, Mr. Quemere requested “…reports related to an incident that occurred on or about July 26, 2019, during which [a named officer] and other officers detained a [named individual] [and] all records related to the lawsuit filed against the officers by [the named individual] in 2021.” Claiming to not yet have received responsive records, Mr. Quemere petitioned this office and this appeal, SPR22/2727, was opened as a result. Subsequently, I learned that the Department provided Mr. Quemere with a response dated December 2, 2022. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Quemere may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
