Assistant General Counsel Executive Office of Public Safety & Security One Ashburton Place, Room 1301 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Candace Africa appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 1, 2022, Ms. Africa requested the following records: [1] MA-DOC contracts and/or agreements that may have been established, for voluntary compliance to federal disability laws. [2] Any Title-II, 28 CFR Parts 35 & 36 US-DOJ ‘Public Entity’ Nondiscrimination covenant(s), whereupon the MA-DOC has functioned as a ‘corporation’ to receive funds, grants, etc. for its compliance to the Americans with Disabilities act. [3] Any EOPSS contracts and/or agreements that may have been established, for compliance of its state & and local agents to the federal ADA laws. Claiming to not yet have received responsive records, Ms. Africa petitioned this office and this appeal, SPR22/2737, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Ms. Africa with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Africa may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
