The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 13, 2022 SPR22/2756 Christina Gibson Public Records Access Officer Massachusetts Port Authority One Harborside Drive, Suite 200S East Boston, MA 02128 Dear Ms. Gibson: I have received the petition of Stevan Johnson appealing the nonresponse of the Massachusetts Port Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 5, 2022, Mr. Johnson requested “… records controlled by Massport showing the aggregate ‘trip fee’ Uber paid Massport for the 24-hour period beginning at 12:01 a.m. on Friday November 4, 2022 and ending at 12:01 a.m. on Saturday … at November 5, 2022.” Claiming to not yet have received responsive records, Mr. Johnson petitioned this office and this appeal, SPR22/2756, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Authority has provided a response. Accordingly, the Authority is ordered to provide Mr. Johnson with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Johnson may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
