See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 4, 2022, Ms. Heywood requested the following records through MuckRock: [1] location of any and all video surveillance cameras located in the [Town]; [2] the policies for all surveillance cameras, video and storage of video; [3] the names of persons who have access to and control of any and all security footage cameras in the [Town] from [September 2, 2020] to September 7, 2022. On October 19, 2022 and November 10, 2022, the Town provided the responsive records on a flash drive. In a November 10th response via email, the Town asserted, “[t]he response will be mailed today via certified return receipt due to the inclusion of a flash drive.” The same day on November 10th, the Town indicated, “[t]the response was mailed via certified return receipt on November 10, 2022. Whereas Ms. Heywood made her request through Muckrock, the Town sent the records to Ms. Heywood through Muckrock. The basis of Ms. Heywood’s appeal is that she did not personally receive the flash drive of the records, and she sought to either pick-up another copy of the records at the Town, or ask the Town to mail it to her home address. The Town notified this office that Ms. Heywood received another copy of the records on a flash drive on December 15, 2022. Where the Town provided the records to Ms. Heywood; accordingly, I will now consider this administrative appeal closed.
