City Solicitor City of Marlborough City Hall, 4th Floor 140 Main Street Marlborough, MA 01752 Dear Attorney Grossfield: I have received the petition of Patrick Hogan appealing the response of the Marlborough Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 18, 2022, Mr. Hogan requested “…copies of the final [specified individual] HR and IA investigation reports together with copies of all witness statements, complaints, notes and supporting materials …” The Department provided a response on November 1, 2022. Unsatisfied with the Department’s response, Mr. Hogan petitioned this office and this appeal, SPR22/2800, was opened as a result. Subsequently, I learned that the Department intends on providing a further response to Mr. Hogan. Accordingly, the Department is ordered to provide Mr. Hogan with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hogan may appeal the substantive nature of Department’s response within ninety days. See 950 C.M.R. 32.08(1).
