See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 5, 2022, Mr. Hilliard requested “…current lease agreement between MBTA and Mark Development for Riverside MBTA station.” The MBTA responded on December 6, 2022. Unsatisfied with the response, Mr. Hilliard petitioned this office and this appeal, SPR22/2805, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a representative of the MBTA, it is my understanding that the MBTA intends on providing a further response to Mr. Hilliard. Accordingly, the MBTA is ordered to provide Mr. Hilliard with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hilliard may appeal the substantive nature of the MBTA’s response within ninety (90) days.
