City of Lowell - Law Department 375 Merrimack Street 3rd Floor, Room 64 Lowell, MA 01852 Dear Attorney Dys-Pierce: I have received the petition of Laura H. Ortiz appealing the response of the City of Lowell (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 31, 2022, Mr. Ortiz requested: [1] School building staff profiles (School Nurses) for all of the individual public schools for school years 2019-2020; 2020-2021; 2021-2022; and, 2022-2023; and, [2] EOY reports for 2019-2020; 2020-2021; and, 2021-2022. On October 31, 2022, John Pyers informed Ms. Ortiz that her request has been received and forwarded to the City’s Health and Human Services. Where Ms. Ortiz did not receive a substantive response or any production of records, on December 8, 2022, Ms. Ortiz petitioned the Supervisor of Records (Supervisor), and this appeal was opened. Based upon a conversation on December 19, 2022, between a senior attorney in the Public Records Division and a legal representative of the City’s Law Department, it is my understanding that the City intends on providing a substantive response to Ms. Ortiz’s request, and intends to produce the records. The City is advised that where possible, it should provide the records on a rolling basis. Conclusion Accordingly, the City is ordered to provide Ms. Ortiz with a response to her request in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
