The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 22, 2022 SPR22/2844 Michelle A. Jenkins Town Clerk Town of Oxford 325 Main Street Oxford, MA 01540 Dear Ms. Jenkins: I have received the petition of Robert King appealing the response of the Town of Oxford (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 26, 2022, Mr. King requested: [1] the record of each dog ordered euthanized by Oxford Animal Control for the period from 9/26/2019 to 9/26/2022 (as required to be filed with the Town Clerk per MGL Ch. 140 Section 151A). [2] the record of each dog bite incident in the town of Oxford for the period from 7/15/2021 to 7/15/2022. ... only ... the initial report of the incident and not additional correspondence, witness testimony, etc. The Town responded on October 11, 2022, providing a fee estimate. Subsequently, Mr. King paid the fees, and the Town responded on November 1, 2022, providing responsive records. Unsatisfied with the Town’s response, and objecting to the fees, Mr. King appealed, and this case was opened as a result. Subsequent to the opening of this appeal, I learned that the Town provided a supplemental response by mail to Mr. King on December 19, 2022. As this appeal was opened based on the Town’s October 11th and November 1st responses, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. King may further appeal the substantive nature of the Town’s supplemental response within ninety (90) days. See 950 C.M.R. 32.08(1).
