Assistant General Counsel Executive Office of Public Safety and Security One Ashburton Place, Room 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Karina Wilkinson appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 29, 2022, Ms. Wilkinson requested records related to: [1] [A]mendments to the Securus Technologies’ contract with the Massachusetts Department of Correction for the prison inmate calling service (ICS)[;] [2] [R]ate changes in response to a new Federal Communication Commission interstate collect call rate cap of 14 cents[;] [3] DOC monthly revenues from inmate calls, video calls and emails, as well as commissions on calls, video calls and emails[;] [4] [M]onthly call volumes and call minutes. Claiming to not yet have received a response, Ms. Wilkinson petitioned this office and this appeal, SPR22/2874, was opened as a result. Subsequently, I learned that the Office intends on providing a written response to Ms. Wilkinson. Accordingly, the Office is ordered to provide Ms. Wilkinson with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Wilkinson may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
