Littlehale Records Access Officer Newburyport Public Schools 70 Low Street Newburyport, MA 01950 Dear Mr. Littlehale: I have received the petitions of Michael Brennan appealing the nonresponse of the Newburyport Public Schools (School) to requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 31, 2022, Mr. Brennan made three requests for “records for all members of the Newburyport Public School Committee members.” Each request referenced records pertaining to a specific date range. Claiming to not yet have received responsive records, Mr. Brennan petitioned this office and these appeals, SPR22/2891, SPR22/2892, and SPR22/2894, were opened as a result. Subsequently, I learned that the School provided Mr. Brennan with a response dated December 21, 2022. Where the basis of these appeals were opened as a result of the School’s lack of a written response, I will now consider these administrative appeals closed. Mr. Brennan may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
