See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 29, 2022, Mr. Rowehl requested: [1] February 4, 2021 Planning Board Meeting Minutes… [2] Any & all documents regarding the moving of the house known as . . . from its original location next to [a specified address] to its current location…. [3] Any documentation having to do with the Town of Charlemont deciding to include or not include the following language (or similar language having the same meaning) in decisions filed with the Town Clerk. This would include any documentation as to Town of Charlemont police (or MA law requiring Town Governments) to inform any person indicating they believe the decision is inaccurate or wrong of the process as indicated in the language below…. [4] Any and all documentation, communications etc. with [t]he Charlemont Police regarding the ongoing land dispute at [a specified address]…. [5] Any and all documentation of the Select Board as to the Land Grab (land dispute) at [a specified address], including any discussion with the Planning Board as to the handling of this & any alleged violations of the Open Meeting Law. [6] Any and all correspondence with Town Council as to the Planning Board Notice of Decision of Site Plan Review June 25, 2015 for [an identified company.] On November 29, 2022, Mr. Rowehl modified his request and requested, “[a]ny & all documents regarding the moving of the house known as … from its original location next to [a specified address] … to its current location….” On December 8, 2022 and December 15, 2022, the Town responded. Kathy Reynolds SPR22/2899 Page 2 January 4, 2023 Town’s responses, Mr. Rowehl petitioned this office and this appeal, SPR22/2899, was opened as a result. Subsequently, I learned that the Town provided a further response dated December 27, 2022, to Mr. Rowehl. Where this appeal was opened as a result of the Town’s December 8th and December 15th responses, I will now consider this administrative appeal closed.
