G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In separate requests, Mr. McPhee requested the following records on November 25, 2022: [1] … any/all information, the Town SelectBoard receives for the meeting on November 22, 2021[;] [2] … emails (sent/received), attachments, text send/received that the Town of Ashby SelectBoard receives or uses for meeting on November 22, 2021[;] [3] … any/all information, the Town SelectBoard receives for the meeting on November 10, 2021[;] [4] …[e]mails (sent/received), attachments, text send/received that the Town SelectBoard receives or uses for meeting on November 10, 2021[;] [5] [a]ny/all information, the Town SelectBoard receives for the meeting on November 19, 2021[;] [6] …emails (sent/received), attachments, text send/received that the Town SelectBoard receives or uses for meeting on November 19, 2021[.] Claiming to not yet have received responsive records, Mr. McPhee petitioned this office and these appeals, SPR22/2915, SPR22/2916, and SPR22/2917, were opened as a result. Subsequently, I learned that the Town provided Mr. McPhee with a response dated December 22, 2022. Where the basis of these appeals were opened as a result of the Town’s lack of a written response, I will now consider these administrative appeals closed. Mr. McPhee may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
