G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 26, 2022, Mr. McPhee requested the following records: [1] …any/all information, the Town SelectBoard receives for the meeting on May 25, 2022[;] [2] …emails (sent/received), attachments, text send/received that the Town SelectBoard receives or uses for meeting on May 25, 2022[;] [3] Item 11. Discuss proposal from Solect Energy Development, LLC to lease town owned land on Foster Road for solar electrical generation facility and battery storage system. Claiming to not yet have received responsive records, Mr. McPhee petitioned this office and this appeal, SPR22/2918, was opened as a result. Subsequently, I learned that the Town provided Mr. McPhee with a response dated December 22, 2022. Where the basis of this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. McPhee may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
