General Counsel Massachusetts Clean Energy Center 294 Washington Street, 11th Floor Boston, MA 02108 Dear Attorney Hitt: I have received the petition of Colman Herman appealing the response of the Massachusetts Clean Energy Center (Center) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 26, 2022, Mr. Herman requested, “[a]ny and all records relating to Mass CEC’s Facility Tour Confidentiality and Release of Liability Agreement.” The Center provided a response on December 16, 2022, Unsatisfied with the response, Mr. Herman petitioned this office and this appeal, SPR22/2924, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Center representative, it is my understanding that the Center intends on providing a further response to Mr. Herman. Accordingly, the Center is ordered to provide Mr. Herman with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. Mr. Herman may appeal the substantive nature of Center’s response within ninety days. See 950 C.M.R. 32.08(1).
