Box 163 West Stockbridge, MA 01266 Dear Ms. Barrett: I have received the petition of Shaw I. Izikson, of the Berkshire Edge, appealing the response of the Town of West Stockbridge (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 6, 2022, Mr. Izikson requested the following records: “[a]ny and all deliberations and communications made via email between members of the Planning Board concerning the 2022 special permit application of The Foundry owned by [an identified individual], and located at . . . Harris Street [in the Town].” On December 6th, Dana Bixby of the Town’s Planning Board informed Mr. Izikson that the Town will assemble the requested records. In a December 20th email, Mr. Izikson inquired on the status of his request. As of December 22nd, Mr. Izikson had not received all the responsive records. As a result of not receiving all the responsive records, Mr. Izikson petitioned the Supervisor of Records (Supervisor), and this appeal was opened. In a December 23rd email, Ms. Bixby, the Chair of the Planning Board, states, “[d]ear Shaw [Izikson], re-sending - the email records are attached, previously sent 12/20/22 records of meetings, incl all docs submitted within the hearing, are posted on the [T]own website under [minutes] - easy to find, I had thought. https://www.weststockbridge-ma.gov/planning-board.” In a December 27th email from Mr. Izikson, he informed the Public Records Division that he received the responsive records, and seeks to withdraw his appeal. Based upon Mr. Izikson’s December 27th email; accordingly, I will consider this administrative appeal closed.
