The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 9, 2023 SPR22/2947 Kevin Partridge Interim Town Administrator Board of Selectmen Town of Berkley 1 North Main Street Berkley, MA 02779 Dear Attorney Williams: I have received the petition of Joan Blake, appealing the response of the Town of Berkley (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 20, 2022, Ms. Blake requested, “[a] [l]etter submitted by [a named person], accepted by the BOS at their 06/22/2022 meeting.” On September 29, 2022, the Town responded. Unsatisfied with the Town’s response, Ms. Blake petitioned this office and this appeal, SPR22/2947, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Ms. Blake. Accordingly, the Town is ordered to provide Ms. Blake with said response, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Blake may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
