Christensen Esq., of Donovan, O’Connor & Dodig, LLP., appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 1, 2022, Mr. Christensen requested “… a copy, or any segregable portion of these records” of the Department’s investigation into a motor vehicle collision on October 30, 2022 including the following documents: [1] Police Reports; [2] Civil Motor Vehicle Crash Reports; [3] Witness statements; [4] Log Notes; [5] Recorded 911 Calls; [6] Turret Tapes; [7] Scene photography or videography, including body worn camera recordings; and [8] Any citations issued as a result of the Department’s response. Claiming to not yet have received responsive records, Attorney Christensen petitioned this office and this appeal, SPR22/2960, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Christensen with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Christensen may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
