Box. 365 Rowley, MA 01969 Dear Ms. Stanton: On December 28, 2022, this office received your petition on behalf of the Rowley Police Department (Department) requesting permission to charge for time spent segregating or redacting responsive records, as well as a waiver of statutory limits on fees that may be assessed in responding to the request. G. L. c. 66, § 10(d)(iv). As required by law, it is my understanding that the Department furnished a copy of this petition to the requestor. G. L. c. 66, § 10(d)(iv). On December 27, 2022, Jonathan Meidanis, Esq., of The Black Law Group LLC, requested: All documents relating to, referring to or otherwise evidencing [a named individual’s] (DOB and SS number provided) arrest and criminal records for as far back as records allow through date of production. Such documents shall include, but shall not necessarily be limited to the following: 1. Complete and accurate copies of any and all police and incident reports related to [a named individual]. 2. Complete and accurate copies of any and all police reports, police narratives, dispatch reports or incident reports related to or citing [a named individual]. 3. Any and all information regarding assessment, evaluations and observations relating to [a named individual]. 4. Any call or 911 logs maintained or correspondence from or to or about [a named individual] to the department. 5. Any records maintained referencing criminal proceedings or district attorney referrals related to [a named individual]. 6. Any and all documents, records, correspondence, affidavits, logs, or otherwise related to [a named individual]. Joy Stanton SPR22/2961 Page 2 January 4, 2023 In an email to this office dated January 1, 2023, Attorney Meidanis states, “[w]e are agreeable to the contents of the letter pertaining to the cost to complete my request for records.” Conclusion In light of the above, it is unnecessary to opine on the Department’s petition seeking permission to charge for time spent segregating or redacting responsive records, as well as the waiver of statutory limits on fees that may be assessed in responding to the request.
