Jarvis Executive Assistant to the Superintendent Northampton Public Schools 212 Main Street, 2nd Floor Northampton, MA 01060 Dear Ms. Jarvis: I have received the petition of Jonathan Gerhardson appealing the response of the Northampton Public Schools (School) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On December 13, 2022, Mr. Gerhardson requested, “[a]ll public records requests made to the Northampton Public School District and School Committee via email between Jan 1, 2020 and Dec.13, 2022.” The School responded on December 28, 2022. Unsatisfied with the School’s response, Mr. Gerhardson petitioned this office and this appeal, SPR22/2962, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a School representative, it is my understanding that the School intends on providing a subsequent response to Mr. Gerhardson. Accordingly, the School is ordered to provide Mr. Gerhardson with said response, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Gerhardson may appeal the substantive nature of the School’s response within ninety days.
