See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 13, 2022, Ms. Ortiz requested the following records: [1] Any policies, instruction or guidance to staff for any student being allowed to leave ‘time on learning’ and/or FAPE (and classroom time) in order for any student to be able to go to a ‘safe space’[;] [2] A blank ‘safe space’ or other named log book sheet that collects the data on these students utilizing ‘safe spaces’ instead of their regularly scheduled classes and is losing out on ‘time on learning’ and/or FAPE[;] [3] A blank ‘safe space’ or other named notifications for any parent that their child has missed ‘time on learning’ and/or FAPE and their regularly scheduled classes in order to go to a ‘safe space’ for special needs and also general education students[.] Claiming to not yet have received responsive records, Ms. Ortiz petitioned this office and this appeal, SPR22/2969, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the City has provided a response. Accordingly, the City is ordered to provide Ms. Ortiz with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office.
