Purple Town Administrator Town of Southborough 17 Common Street Southborough, MA 01532 Dear Mr. Purple: I have received the petition of Thomas Grillo, of the Boston Globe, appealing the response of the Town of Southborough (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 14, 2022, Mr. Grillo requested “. . . any documents pertaining to the suspension, investigation that led to [an identified individual’s] departure including the investigative report written by [an identified person] or other independent attorney appointed by the Select Board.” Subsequently the Town responded. Unsatisfied with the Town’s response, Mr. Grillo petitioned this office and this appeal, SPR23/0011, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Town representative, it is my understanding that the Town intends on providing a further response to Mr. Grillo. Accordingly, the Town is ordered to provide Mr. Grillo with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Grillo may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
