G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On December 20, 2022, Ms. Shelly requested, “[a]ll communication on topic of the ABCC appeal by Fashionable concepts, including emails…” The City responded on January 5, 2023. Unsatisfied with the City’s response, Ms. Shelly petitioned this office and this appeal, SPR23/0020, was opened as a result. Based upon a conversation between a Public Records Division staff member and a City representative, it is my understanding that the City intends on providing a further response to Ms. Shelly. Accordingly, the City is ordered to provide Ms. Shelly with a response to the request in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Shelly may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
