The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 24, 2023 SPR23/0033 Samuel Miller Department of State Police – Crime Laboratory 124 Acton Street Maynard, MA 01754 Dear Mr. Miller, I have received the petition of Gerard Sullivan appealing the nonresponse of the Department of State Police Crime Laboratory (Crime Lab) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 2, 2022, Mr. Sullivan requested all files related to an identified court case. Claiming to not yet have received a response, Mr. Sullivan petitioned this office and this appeal, SPR23/0033, was opened as a result. Subsequently, I learned that the Crime Lab provided a response to Mr. Sullivan on January 11, 2023. Where the basis of this appeal was opened as a result of the Crime Lab’s lack of a written response, I will now consider this administrative appeal closed. Mr. Sullivan may appeal the substantive nature of the Crime Lab’s January 11th response within 90 days. See 950 C.M.R. 32.08(1).
