See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 13, 2022, Dr. Farrell requested the following records: [1] All documents reflecting current policies and protocols on Hepatitis C and HIV[;] [2] Any documents relating to policies around Hepatitis C testing (i.e., testing protocols)[;] [3] Any documents relating to policies around HIV testing[;] [4] Any documents relating to Hepatitis C treatment (treatment protocols)[;] [5] Any documents relating to HIV treatment[;] [6] Any documents related to the number of Hepatitis C tests requested by inmates[;] [7] Any documents related to the number of HIV tests requested by inmates[;] [8] Any documents reflecting the total number of people testing for Hepatitis C in 2021 (by race and ethnicity, if possible)[;] [9] Any documents reflecting the total number of people testing for HIV in 2021 (by race and ethnicity, if possible)[;] [10] A copy of the medical intake form[.] Claiming to not yet have received responsive records, Dr. Farrell petitioned this office and this appeal, SPR23/0040, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response.
