The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 25, 2023 SPR23/0056 Katherine Jackson Executive Assistant Topsfield Police Department 210 Boston Street Topsfield, MA 01983 Dear Ms. Jackson: I have received the petition of Michael Kane, appealing the response of the Topsfield Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 6, 2022, Mr. Kane requested: [1] … all police reports relating to [named locations and an identified individual] from 8-23-22 to the present (8-23-22 was when my prior request ended so their should be no overlap) [2] …any videos or other evidence that the Topsfield police posses[s] and may or may not be presenting at a clerks hearing scheduled for 110-23 at Newbury district court related to police report 22TOP-119-AR and [3] any other police reports related to this incident. On January 3, 2023, the Department responded. Unsatisfied with the Department’s response, Mr. Kane petitioned this office and this appeal, SPR23/0056, was opened as a result. Subsequently, I learned that the Department responded to Mr. Kane with a further response sent on January 24, 2023. Where the basis of this appeal was opened as a result of the Department’s January 3, 2023 response, I will now consider this administrative appeal closed. Mr. Kane may appeal the substantive nature of the Department’s January 24th response within ninety days. See 950 C.M.R. 32.08(1).
