See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 23, 2022, Mr. Austin made the following requests: [1] Any and all records, files, correspondence, email, or text messages sent to Kleinfelder, FXM, or any other wastewater study contractor or subcontractor by any North Reading employee, board, committee, working group or other entity[;] [2] Any and all records, files, correspondence, email, or text messages received from Kleinfelder, FXM, or any other wastewater study contractor or subcontractor by any North Reading employee, board, committee, working group or other entity. [3] Any and all email traffic to/from [an identified] email account[;] [4] Any email or other document, file or record sent in response to email received at that address… Claiming to not yet have received responsive records, Mr. Austin petitioned this office and these appeals, SPR23/0057 and SPR23/0058, were opened as a result. Despite being notified of the opening of these appeals, it is unclear whether responses have been provided. Accordingly, the Town is ordered to provide Mr. Austin with responses to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such responses must be provided to this office. It is preferable to send an electronic copy of the responses to this office at pre@sec.state.ma.us.
