Roche, Esq. 2nd Associate City Solicitor City of Springfield Law Department 36 Court Street, Room 210 Springfield, MA 01103 Dear Attorney Roche: I have received your petitions on behalf of the City of Springfield (City) requesting a waiver of statutory limits to fees that may be assessed in responding to requests, and permission to charge for time spent segregating and/or redacting responsive records. G. L. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the City furnished a copy of these petitions to the requestor. G. L. c. 66, § 10(d)(iv). On January 3, 2023, Patrick Goodreau, Esq. requested “[d]isciplinary records of [an identified individual]-Springfield Police Officer; All internal affair documents.” On January 3, 2023, Attorney Goodreau also requested “[d]isciplinary records of [an identified individual] Springfield Police Officer[;] All internal affair documents[.]” In an email dated January 19, 2023, Attorney Goodreau states, “[p]lease withdraw. I anticipate pursuing records through rule 17.” The City responds, “[t]hank you for confirming your withdrawal of the Appeals. We will close the original requests.” Conclusion In light of the above, I find it is unnecessary to opine on the City’s petitions at this time.
