The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 31, 2023 SPR23/0080 Danielle Paradis Records/Property Supervisor Barnstable Police Department 1200 Phinney’s Lane Hyannis, MA 02061 Dear Ms. Paradis: I have received the petition of Andrew Quemere appealing the response of the Barnstable Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 9, 2022, Mr. Quemere requested numerous documents regarding the Department’s current use-of-force policies. Prior Appeals This request was the subject of previous appeals. See SPR22/2024 Determination of the Supervisor of Records (September 16, 2022) and SPR22/2253 Determinations of the Supervisor of Records (October 19, 2022 and November 22, 2022). In my October 19th determination, this office requested an in camera review of the requested records. On November 2, 2022, the Department provided an un-redacted copy of the records for an in camera review. Upon review, I found that the Department must clarify how the redacted portions could identify a specific individual. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Mr. Quemere. Accordingly, the Department is ordered to provide Mr. Quemere with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
