Donahue appealing the response of the Georgetown Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 5, 2022, Mr. Donahue requested the following records: 1. The Request for Proposals to bid on the subject contract 2. The names and addresses of all persons or businesses directly solicited by the Public Schools to submit a bid in response to the Request for Proposals; 3. The venues of public notice for the RFP; [e.g. Central Register] 4. The proposals including fees received in response to the Request for Proposals; 5. If no Request for Proposals for the subject contract was issued, provide the procurement officer’s written determination that only one practicable source for the required supplies or services exists; 6. If no Request for Proposals for the subject contract was issued, provide the procurement officer’s written basis for determining that such services are exempt from the requirements of c. 30B; 7. The source[s] of funding used to pay the subject contracts. On December 7, 2022, the School responded. On December 28, 2022, Mr. Donahue modified his request to include additional records. On January 9, 2023, the School provided a further response. Unsatisfied with the School’s response, Mr. Donahue petitioned this office and this appeal, SPR23/0094, was opened as a result. Subsequently, I learned that the School responded to Mr. Donahue’s request with a further response sent on January 28, 2023. Where the basis of this appeal was opened as a result of the School’s January 9, 2023 response, I will consider this administrative appeal closed.
