Records Access Officer Executive Office of Health & Human Services 1 Ashburton Place Boston, MA 02108 Dear Attorney Scanlan: I have received the petition of Michael Damiano appealing the nonresponse of the Executive Office of Health & Human Services (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 4, 2023, Mr. Damiano requested “[a]ll records referenced in the January 3 letter sent to [named] Secretary by [named] Inspector General. These records include but are not limited to ‘seven reports from the EHS Investigations Unit and one report from a member of [named Secretary’s] leadership team.’ According to the letter, these records were sent to the Office of the Inspector General on December 22, 2022.” Claiming to not yet have received responsive records, Mr. Damiano petitioned this office and this appeal, SPR23/0118, was opened as a result. Subsequently, I learned that the Office provided Mr. Damiano with a response dated January 20, 2023. Where the basis of this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Damiano may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
