See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 4, 2022, Mr. Pace requested the following records: [1] All documents…related to any and all reprimands, suspension or disciplinary hearings of Department’s [named individuals] from January 13, 2013 to present[;] [2] All documents relating to reports filed by any inmate against [named individuals] from January 1, 2013 to present[;] [3] All documents…relating to reports of violence in the L1 housing unit of Souza Baranowski Correctional Center made by any inmate from January 1, 2015 to present[;] [4] All documents related to Department’s [named individuals] regarding all investigations pertaining to conflicts of Andre Pace and other inmates from January 1, 2013 to present day [;] [5] All video footage from the L1 housing unit of Souza Baranowski Correctional Center on April 20, 2015 and the H1 housing unit of Souza Baranowski Correctional Center on June 21, 2016[.] Claiming to not yet have received responsive records, Mr. Pace petitioned this office and this appeal, SPR23/0126, was opened as a result. Subsequently, I learned that the Department provided a further response to Mr. Pace on January 23, 2023. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Pace may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
