Assistant District Attorney Norfolk County District Attorney’s Office 45 Shawmut Road Canton, MA 02021 Dear Attorney Monahan: I have received the petition of David G. Magraw appealing the nonresponse of the Norfolk County District Attorney’s Office (Office/NDAO) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 8, 2022, Mr. Magraw requested the following records: [1] Copy of the recording, with the findings, opinions and determinations, that would have been made by [named individual]…the evening of July 24, 1990…[;] [2] What was/when were the previous time/times, date/dates, that [named individual] again went to Old Post Road. Who was the neighbors/were the neighbors that [named individual] spoke with at that time/those times[.] Claiming to not yet have received responsive records, Mr. Magraw petitioned this office and this appeal, SPR23/0137, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Magraw with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. Mr. Magraw may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
