Assistant District Attorney Records Access Officer Plymouth District Attorney’s Office 166 Main Street Brockton, MA 02301 Dear Attorney Palumbo: I have received the petition of Colman M. Herman appealing the nonresponse of the Plymouth District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 16, 2022, Mr. Herman requested a copy of a specific police report that he had previously inquired about. Claiming to not yet have received a response, Mr. Herman petitioned this office and this appeal, SPR23/0139, was opened as a result. Subsequently, I learned that the Office intends on providing a written response to Mr. Herman. Accordingly, the Office is ordered to provide Mr. Herman with a response in a manner consistent with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
