Scenna Superintendent Lynnfield Center Water District 83 Phillips Road Lynnfield, MA 01940 Dear Superintendent Scenna: I have received the petition of Brian D. McGrail, Esq. appealing the nonresponse of the Lynnfield Center Water District (District) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 4, 2023, Mr. McGrail requested the following records: [1] …environmental reports or studies, testing results of water that was drained from the tank, a list of chemicals or cleaning solutions used to clean the tank, and information as to where water and sediment from the tank was disposed of or dispersed[;] [2] …information and documentation of the verification of where outfall for the Wing Road Tank area is located as was required… Claiming to not yet have received a response, Mr. McGrail petitioned this office and this appeal, SPR23/0140, was opened as a result. Subsequently, I learned that the District intends on providing a written response to Mr. McGrail. Accordingly, the District is ordered to provide Mr. McGrail with a response in a manner consistent with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. McGrail may appeal the substantive nature of the District’s response within ninety days. See 950 C.M.R. 32.08(1).
