Scanlan Primary Records Access Officer Executive Office of Health and Human Services One Ashburton Place, 11th Floor Boston, MA 02108 Dear Ms. Scanlan: I have received the petition of Michael Damiano, of the Boston Globe, appealing the nonresponse of the Executive Office of Health and Human Services (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 6, 2023, Mr. Damiano requested “…all emails, and all attachments to those emails, sent or received by [named individuals] referencing the Superintendent of the Chelsea Soldiers’ Home, between September 15, 2022 and October 10, 2022.” Claiming to not yet have received responsive records, Mr. Damiano petitioned this office and this appeal, SPR23/0152, was opened as a result. Subsequently, I learned that the Office provided Mr. Damiano with a response dated January 20, 2023. Where the basis of this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. It is my understanding that Mr. Damiano has appealed the Office’s January 20, 2023 response resulting in a new appeal which is currently opened as SPR23/0190.
