Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Taylor Dolven, of the Boston Globe, appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 18, 2023, Ms. Dolven requested the following records: [1] Video recordings from all cameras in the Broadway T station between the hours of 12:00am and 2:00am on April 10, 2022[;] [2] T maintenance and inspection records of Red Line car #1510 and car #1511 from January 1, 2021 to April 10, 2022[;] [3] Discipline records of the driver of the train involved in the death of [a named person] on April 10, 2022… [;] [4] Incident report/log from the dispatcher related to the April 10, 2022 death of [a named person] at or near Broadway station from 12:00am to 3:00am[.] The MBTA provided a response on January 25, 2023. Unsatisfied with the MBTA’s response, Ms. Dolven petitioned this office and SPR23/0157, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a MBTA representative, it is my understanding that the MBTA intends on providing a further response to Ms. Dolven to address the January 18th record request. Accordingly, the MBTA is ordered to provide Ms. Dolven with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Dolven may appeal the substantive nature of the MBTA’s response within ninety days. See 950 C.M.R. 32.08(1).
