G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 13, 2022, Ms. Belenkiy requested: the following materials used in grade 5-12 sex-Ed. - Slides and other digital presentation materials - Homework assignments - Handouts given in class - Surveys - Digital documents containing URLs or titles of videos show in class. In further correspondence from December 23, 2022, through January 17, 2023, Ms. Belenkiy and the School discussed a timeline for providing responsive records. Having received no further response from the School, Ms. Belenkiy appealed and this case was opened as a result. Subsequent to the opening of this appeal, I learned that the School provided a supplemental response by email to Ms. Belenkiy and this office on February 3, 2023. As this appeal was opened based on the School’s previous responses, I will now consider this administrative appeal closed. If unresolved issues remain, Ms. Belenkiy may further appeal the substantive nature of the School’s February 3rd response within ninety (90) days. See 950 C.M.R. 32.08(1).
