Chief Regional Counsel Department of Environmental Protection Central Regional Office 8 New Bond Street Worcester, MA 01606 Dear Attorney Blackman: On January 31, 2023, this Office received your petition on behalf of the Department of Environmental Protection (Department) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(d)(iv). As required by law, it is my understanding that the Department furnished a copy of this petition to the requestor. G. L. c. 66, § 10(d)(iv). On January 17, 2023, Stacey Pietrowicz, Esq., of Sugarman and Sugarman, P.C., requested “the complete file maintained by [the Department] on [an identified company] of [an identified location], which property is owned by [an identified company].” In an email to a staff attorney in this office dated January 31, 2023, Attorney Blackman states: Attorney Pietrowicz has withdrawn her public records request dated January 17, 2023. Therefore, the fee petition that I submitted is moot. Attorney Pietrowicz made a new public records request today for the records that we provided to another attorney on October 25, 2023, and MassDEP will provide these records to attorney Pietrowicz free of charge.
