Harris, Ph.D. Town Clerk Town of Boxborough 29 Middle Road Boxborough, MA 01719 Dear Dr. Harris: I have received the petition of Warren Ryder appealing the response of the Town of Boxborough (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 18, 2023, Mr. Ryder requested copies of grand jury subpoenas for a specific investigation requested by the Town. The Town provided a response on January 31, 2023. Unsatisfied with the response, Mr. Ryder petitioned this office and this appeal, SPR23/0189, was opened as a result. Based upon a conversation between a representative of the Town and a staff attorney of the Public Records Division, it is my understanding that the Town intends on providing a further response to Mr. Ryder to address the record request. Accordingly, the Town is ordered to provide Mr. Ryder with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Ryder may appeal the substantive nature of the Town’s response within ninety days. See 950 C.M.R. 32.08(1).
