Scanlan Records Access Officer Executive Office of Health and Human Services One Ashburton Place, Room 1109 Boston, MA 02108 Dear Ms. Scanlan: I have received the petition of Mike Damiano, of the Boston Globe, appealing the response of the Executive Office of Health and Human Services (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 6, 2023, Mr. Damiano requested “all emails, and all attachments to those emails, sent or received by [two named individuals] referencing ... the superintendent of the Chelsea Soldiers’ Home, between September 15, 2022 and October 10, 2022.” This request was the subject of a previous appeal. See SPR23/0152 Determination of the Supervisor of Records (February 1, 2023). In my February 1st determination, I closed SPR23/0152 in light of the Office providing Mr. Damiano with a written response on January 20, 2023, stating that the Office would provide a further response by January 30, 2023. Having received no further response, Mr. Damiano appealed, and this case was opened as a result. Subsequent to the opening of this appeal, I learned that the Office provided a supplemental response by email to Mr. Damiano on February 1, 2023. As this appeal was opened based on the Office’s January 20th response, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. Damiano may further appeal the substantive nature of the Office’s February 1st response within ninety (90) days. See 950 C.M.R. 32.08(1).
