G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 1, 2022, Mr. Quemere requested a, “… scan of the litigation index you mentioned?” Prior appeals This request was the subject of previous appeals. See SPR22/2879 Determination of the Supervisor of Records (December 30, 2022) and SPR22/2970 Determination of the Supervisor of Records (January 17, 2023). The City responded on January 31, 2023. Unsatisfied with the response, Mr. Quemere petitioned this office and this appeal, SPR23/0191, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a City representative, it is my understanding that the City intends on providing a further response to Mr. Quemere to address the exemptions not required by law as well as provide additional details regarding the calculation of the fee estimate. Accordingly, the City is ordered to provide Mr. Quemere with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Quemere may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
