General Counsel Department of Veterans Services 600 Washington Street, 7th Floor Boston, MA 02111 Dear Attorney Deacon: I have received the petition of Michael Damiano, of the Boston Globe, appealing the response of the Department of Veterans Services (Department) to a request for public records. G. L. c. 66, §10A; see also 950 C.M.R. 32.08(1). On January 5, 2023, Mr. Damiano requested, “[a]ll Department emails, as well as all attachments to those emails, referencing [a named person] … from October 1, 2020 through December 15, 2020.” The Department responded on January 20, 2023. Unsatisfied with the response, Mr. Damiano petitioned this office and this appeal, SPR23/0193, was opened as a result. Subsequently, I learned that the Department provided a further response to Mr. Damiano on February 2, 2023. Where this appeal was opened as a result of the Department’s January 20th response, I will now consider this administrative appeal closed. Mr. Damiano may appeal the substantive nature of the Department’s February 2nd response within ninety (90) days. See 950 C.M.R. 32.08(1).
