Sgobba, Esq., of Calabrese Law Associates, P.C., on behalf of her client, Amrut Corporation d/b/a/ Elixir Lounge, appealing the response of the City of Methuen (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 19, 2022, Attorney Sgobba requested numerous documents related to Elixir Lounge in the City’s possession. Previous appeal This request was the subject of a previous appeal. See SPR22/2102 Determination of the Supervisor of Records (September 28, 2022). The City provided a response on January 27, 2023. Unsatisfied with the City’s response, Attorney Sgobba petitioned this office and this appeal, SPR23/0196, was opened as a result. Based upon a conversation between a representative of the City and a staff attorney of the Public Records Division, it is my understanding that the City intends on providing a further response to Attorney Sgobba to address the records request. Accordingly, the City is ordered to provide Attorney Sgobba with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Sgobba may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
