The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 14, 2023 SPR23/0202 Alexandra Hayden Records Access Officer Chelmsford Police Department 3 Olde North Road Chelmsford, MA 01824 Dear Ms. Hayden: I have received the petition of Stanley Mazurczyk appealing the response of the Chelmsford Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 11, 2022, Mr. Mazurczyk stated, “[a]ttached is July 2021 Chelmsford Police Department (Department) Verizon invoice. Page 5 reveals [named person] operates Town of Chelmsford (Town) paid for redacted cell phone. It’s unclear if [named person] is Department employee exploiting Town funds. I request Town provide record of [named person] employment status at that and current time. Reason for redacting cell phone number assigned to her.” Prior appeal This request was the subject of a previous appeal. See SPR22/2707 Determination of the Supervisor of Records (December 8, 2022). The Department responded on December 22, 2022. Unsatisfied with the response, Mr. Mazurczyk petitioned this office and this appeal, SPR23/0202, was opened as a result. Based upon a conversation between a Public Records Division senior attorney and a Department representative, it is my understanding that the Department intends on providing a further response to Mr. Mazurczyk. Accordingly, the Department is ordered to provide Mr. Mazurczyk with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mazurczyk may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
