The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 24, 2023 SPR23/0260; SPR23/0261 Allison Mondello Primary Records Access Officer Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello, I have received the petition of Nicholas Jackman appealing the nonresponse of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 24, 2023 and January 25, 2023, Mr. Jackman requested, a copy of the Department’s policies “on motor vehicle traffic stops [and] use of speed enforcement equipment ...” Mr. Jackman also requested, “...vehicle service records used during [an identified] citation ... from the beginning of the year ... to ... 12/9/2022...” Claiming to not yet have received responsive records, Mr. Jackman petitioned this office and these appeals, SPR23/0260 and SPR23/0261, were opened as a result. Despite being notified of the opening of these appeals, it is unclear whether a response has been provided. Accordingly, the Department is ordered to provide Mr. Jackman with a response to the requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Jackman may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
