Assistant District Attorney Suffolk County District Attorney’s Office One Bulfinch Street Boston, MA 02114 Dear Attorney Doherty: I have received the petition of Kyle Bryant appealing the nonresponse of the Suffolk County District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 31, 2022, Mr. Bryant requested various documents related to a particular court case. Claiming to not yet have received responsive records, Mr. Bryant petitioned this office and this appeal, SPR23/0265, was opened as a result. Subsequently, I learned that the Office provided a response to Mr. Bryant dated February 14, 2023. Where the basis of this appeal was opened as a result of the District’s lack of a written response, I will now consider this administrative appeal closed. Mr. Bryant may appeal the substantive nature of the Office’s February 14th response within 90 days. See 950 C.M.R. 32.08(1).
